1. Introduction

These Terms and Conditions ("Terms") govern the relationship between Property Lettings Group ("we," "us," or "our") and the tenant(s) ("you" or "tenant") for all properties rented through our agency. By entering into a rental agreement with Property Lettings Group, you agree to comply with these Terms and Conditions.

2. Definitions

  • Landlord: The legal owner of the rental property.
  • Tenant: The individual(s) renting the property.
  • Tenancy Agreement: The legal document signed by the landlord and tenant outlining the terms of the tenancy.
  • Property: The residential unit (house, flat, or apartment) rented to the tenant.

3. Tenancy Agreement

  • A tenancy agreement will be provided prior to moving in, which must be signed by all tenants and the landlord.
  • The tenancy agreement outlines the specific terms of the rental, including the duration, rent, and any special provisions.
  • Tenants must adhere to the terms specified in the tenancy agreement throughout the duration of the tenancy.

4. Rent and Fees

  • Rent Payments: Rent must be paid in full on the agreed-upon date each month, as specified in the tenancy agreement.
  • Late Payments: Late payment of rent may result in additional fees or legal action.
  • Security Deposit: A security deposit will be collected as outlined in the tenancy agreement. This deposit will be protected in a government-approved deposit protection scheme and returned to the tenant at the end of the tenancy, minus any deductions for damages or unpaid rent.
  • Administrative Fees: Any applicable fees, including holding deposits, tenancy renewals, or changes to the tenancy, will be disclosed prior to the start of the tenancy.

5. Property Maintenance and Repairs

  • Landlord Responsibilities: The landlord is responsible for ensuring that the property meets basic health and safety requirements.
  • Tenant Responsibilities: Tenants must maintain the property in good condition and report any maintenance issues promptly.
  • Repairs: Tenants must allow access to the property for scheduled repairs or maintenance, provided they are given reasonable notice.
  • Emergency Repairs: In case of an emergency (e.g., gas leaks, electrical issues), tenants should contact us immediately to arrange for urgent repairs.

6. Safety Certificates

  • Property Lettings Group provides free Electrical Safety and Gas Safety Certificates for each property. These are conducted by fully insured and qualified professionals to ensure compliance with UK regulations.
  • The tenant agrees to cooperate with scheduled inspections and testing to maintain compliance with safety standards.

7. Tenant Obligations

  • Use of Property: The property must be used as a private residence only and not for business or illegal activities.
  • Subletting: Subletting is not permitted without prior written consent from the landlord.
  • Pets: Tenants may only keep pets if approved by the landlord and documented in the tenancy agreement.
  • Noise and Disturbances: Tenants must avoid causing disturbances that may interfere with neighbors' quiet enjoyment of their property.

8. Landlord Obligations

  • Privacy: Landlords and agents must respect tenant privacy and provide a minimum of 24 hours’ notice before entering the property, except in emergencies.
  • Repairs and Maintenance: Landlords are responsible for the repair and maintenance of essential services such as plumbing, heating, and electrical systems.

9. End of Tenancy

  • Notice: Tenants must provide notice of their intention to vacate according to the terms specified in the tenancy agreement.
  • Condition of Property: Tenants must return the property in the same condition as it was at the start of the tenancy, allowing for fair wear and tear.
  • Deposit Return: The security deposit will be returned to the tenant after an inspection of the property, with any deductions for damages or unpaid rent noted.

10. Data Protection and Privacy

  • Property Lettings Group will handle all tenant data in accordance with the UK Data Protection Act 2018 and GDPR.
  • Personal information will only be used for purposes related to the tenancy, including verification, communications, and legal compliance.
  • By entering into a tenancy agreement, you consent to our use of your information as outlined in our Privacy Policy.

11. Liability

  • Property Lettings Group and the landlord are not liable for any personal injury, damage, or loss suffered by tenants unless it arises from negligence or failure to meet safety standards.
  • Tenants are encouraged to obtain renters' insurance to protect their belongings and liability.

12. Dispute Resolution

  • Disputes with the Landlord: Any disputes arising during the tenancy should be resolved directly between the landlord and tenant. Property Lettings Group will act as a mediator when necessary.
  • Dispute over Security Deposit: If there is a disagreement over the return of the security deposit, the tenant can seek assistance through the deposit protection scheme's dispute resolution service.
  • Legal Action: Both parties retain the right to seek legal action if a resolution cannot be reached.

13. Changes to Terms and Conditions

  • Property Lettings Group reserves the right to amend these Terms and Conditions. Tenants will be notified of any changes that materially affect their tenancy.

14. Governing Law

  • These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the jurisdiction of the courts in England and Wales.
